Ex wife backtracking on agreement....

I was divorced in 2003, there was one child.  We agreed by mediation that in order for her to stay in a decent area, i would lend her my share of the equity in the marital home to enable her to buy another home and she would repay me when my child reached 16 or she remarried or moved.  Unfortunately, i did not get the second charge signed off at the time and now i have mentioned it she is refusing to play ball.  I have since remarried and had another child.  She has now got the CSA involved despite me paying monthly payments since the split in 2002.  Is is too late to apply for this second charge to be put on her property?
