Legal help - does he pay?

Hi I'm in the process of divorcing my husband. As I work part time I get legal help which is the first tier of legal aid therefore unless things end up going to court I will not have to pay for any solicitor costs. My question is will my husband have to pay? if he doesn't contest the divorce/financial settlement and it doesn't go to court will he end up having to pay my costs? I'm confused as I didn't think he would have to and seems a bit unfair on him if he does S

The short answere is no.  If you are the petitioner you can make a claim in your petition for your husband to pay your costs and the court then decides on this issue.  However you are not obliged to claim costs.  If you don't he won't!  He will only have to pay any legal costs which he incurs with his solicitor.
