Property

I have been separated from my husband for sixteen months now and can no longer afford to pay the mortgage on my own.  The house has been sold and the net proceeds will be split 50/50.  I am having to move out of London as I cannot afford the London prices.  My husband was served divorce papers in November 2006.  I asked him why he has not acknowledge the papers and he says that he will be defending himself and will not be paying for anything.    My question is this: can my husband make a claim on the new property that I am buying as we are still married?  The two children I have with my husband will be coming to live with me.
