When it comes to serving papers on the respondent please can anyone answer the following?
the papers are to request for an attachment of earnings order and to be completed by my ex-husband. He is crafty as hell any likes to avoid things. I've now sent court papers by special delivery twice for him to fill out attachment of earnings. Each time they've come back to sender, which is me. The second time this happened the post office has clarified that when they attempted to post someone answers the door and says 'addressee not known at this address'.
He is just being clever as he had a court order sent prior to last court date in November 09 to attend court. He never turned up. He called the court making excuses he had gone to wrong court. The address of court was very clear. So the fact is he knows whats coming at him as next date in Feb he has to give answers about his earnings and i know he doesnt want to. I shouldn't have to process serve as it could cost me £70-£100. On the request form i filled in his home and work address. Im wondering if the papers can be served at his work address as i made a call to check if he was working there and they confirmed he is, even if he wants to lie that he is not known at home address?
or do i need permission from court to use work address instead of home? Also please advise of any other ideas to give service?.....This is for enforcement of maintenance that hasnt been paid.
