I married a German national two and a half years ago, he moved to the UK 17 months after marriage and 14 months after our first child was born.   I took one year’s maternity leave and went back to work three days a week. My husband was still in Germany when I went back to work, so I had to leave our child with my parents and spend two nights a week in London (something I was and still am unhappy about) and the rest of the time at my parents. I have felt like a single mother from the off set.  My husband  finally moved over one year ago and spent 6 months re training . He found  employment six months ago and up until now, I have paid for everything.   I have a property, for which I pay the mortgage, bills etc. He is living in this property and refuses to get a home together for all of us suitable for a family.  Earlier in the year I arranged a post nuptial agreement which was signed by both of us. For a number of reasons the marriage has broken down, it never really took off and I want to separate, my husband refuses to move out. For such a short lived marriage to which there are no joint assets, or even bank accounts , could he have a claim?
